Student Markets
UTC aims to provide a safe environment for students to gain hands-on commercial production and business experience. Subject to the requirements and restrictions outlined below, UTC students may host student market events in approved areas on campus during which UTC students are permitted to engage in commercial solicitation of goods and services for profit.
Eligibility to Register for a Student Market:
• Only students enrolled at UTC are eligible to register for and host student markets on campus.
• Student applicants must be in good disciplinary standing (i.e., not on disciplinary probation or subject to other disciplinary sanctions) and good academic standing (i.e., not on academic probation) at UTC.
External Entities and Persons Prohibited From Selling Goods and Services:
• External entities and persons unaffiliated with UTC are not eligible to register for or host a student market or otherwise display or sell goods or services at a student market event.
• Students are prohibited from selling goods or services on behalf of an external entity or person during student market events.
Permissible Goods and Services:
• Student vendors may sell only goods and services produced by UTC students, except as otherwise explicitly authorized by these rules.
• Sale of vintage/used clothing is permitted if the student sources and owns the items for sale and/or provides proof that the student vendor is the principal owner of the business that owns the items for sale.
• Student vendors are not permitted to sell goods and services containing intellectual property (IP) owned by a third party unless the student vendor has a license from the third party to use and sell goods or services containing the third party's IP.
o Student vendors are prohibited from using or selling goods containing UTC's name, trademarks, logos, or other intellectual property without a license or express authorization from UTC.
o "Fan art" items (e.g., paintings, drawings, clothing, etc.) in which trademarked names, images, logos, or other types of IP are incorporated into the item (e.g., t-shirts containing Star Wars characters) are prohibited unless the student vendor has a license to use and sell such IP.
• Student vendors are prohibited from selling the following:
o Weapons or replicas of weapons of any kind
o Alcohol, Tobacco, Products containing cannabidiol (CBD), Any controlled substance or paraphernalia, Hazardous chemicals, Sexually explicit materials, Gambling items or raffles of any kind, On-site tattooing or piercing, Counterfeit goods
o Any other good or service prohibited under UTC policy or law or that UTC, in its sole discretion, deems inappropriate
Terms and Requirements of Operation:
• Insurance: A Certificate of Insurance (COI) must be procured in order to host a student market at any campus space, naming the University as an additional insured. The COI must cover general liability at a standard established by the University. The language of the COI must reflect the University’s established standard for general event liability. Student(s) may procure a COI from any legitimate Tenant Users Liability Insurance Policy (TULIP) style insurer, unless there is a contracted provider established with the University. At which point, the student(s) must procure the COI from the University approved contractor.
• Sales and Financial Management and Accounting: Student vendors are solely responsible for managing and accounting for their sales, proceeds, expenses, and operational finances associated with selling goods and services during a student market event. UTC will not be party to any sales during a student market event, nor will it be responsible for managing or accounting for any sales, proceeds, or operational finances of a student vendor.
• Acceptable Forms of Payment: Student vendors may accept only cash or electronic payment for goods or services sold at a student market event. All other forms of payment are prohibited. When possible, electronic payments shall be the preferred method to complete transactions. Student vendors are responsible for carrying change and attaining lockboxes to hold cash on hand. If cash is the only payment type accepted by a student vendor, the student vendor should have at least two people present for all transactions.
• Sales Taxes: Student vendors are solely responsible for the registration, collection, and remittance of any sales taxes and other taxes required under the law and shall be solely liable for collecting and remitting all required taxes to the appropriate taxing authorities. Student vendors must maintain records of all transactions in a ledger for tax and audit purposes, which shall be made available to UTC upon request.
• IP Licenses: If a student vendor produces or sells goods or services that contain intellectual property (IP) owned by a third party, the student must procure a license or other written authorization from the IP owner to sell such goods or services. Goods or services containing IP that a student is not authorized to use or sell are prohibited.
• Disclaimer of UTC Liability: UTC's approval of a student market event shall in no way be viewed or considered as an endorsement or warranty by UTC of the condition, use, or merchantability of the goods or services sold at the student market. A student vendor shall be solely responsible for any injuries, damages, costs, and other liability arising from or relating to the goods and services sold by the student vendor at a student market.
• Market Catalog: The student organizer of a student market event must provide a catalog that identifies all goods and services that will be sold at the student market and each student vendor of such goods and services. Failure to provide a market catalog prior to the approved date for the student market (See Student Market Procedure – Section 1 Required Documents) will result in cancellation of the student market.
• Compliance with UTC Policies: Student organizers and vendors of a student market are responsible for ensuring the student market is operated in accordance with all UTC policies, including without limitation, UTC's policies on non-discrimination. Set-ups for student markets must comply with any applicable requirements under the American with Disabilities Act (ADA).
• Collection of Sensitive Customer Data Prohibited: Student vendors shall not collect and store sensitive data of customers for any reason, including, without limitation, credit card information and personally identifiable information (PII).
• Post-Event Cleanup: Student organizers and vendors of a student market are responsible for proper cleanup of the student market space at the conclusion of the event. Student markets must submit a proper post-event cleanup plan for approval prior to the event. No items may be left in or around the student market space after the event ends.
• Health and Safety: Student organizers and vendors of student markets are responsible with following all health and safety policies and regulations applicable to on-campus events. The UTC Department of Public Safety reserves the right to inspect, postpone, and/or cancel a student market event that it deems to pose a health and safety risk to UTC and the campus community.
Enforcement of Student Market Rules and Requirements:
• The University Center is responsible for enforcing the student market rules and requirements. Participating in a student market event is a privilege, not a right, and such privilege may be revoked by the University Center at any time for failure to follow the rules and requirements for student markets.
• Students who fail to comply with the student market rules and requirements may have their privilege to participate in student markets temporarily or permanently revoked, as determined by and within the discretion of the University Center Director. The University Center Director shall provide written notice to the student of any temporary or permanent revocation of their privilege to participate in student markets. The student may appeal a temporary or permanent revocation to the Vice Chancellor for Enrollment Management and Student Affairs within thirty (30) days of receipt of the notice from the University Center Director. The decision of the Vice Chancellor for Student Affairs on the student's appeal is final and not subject to further appeal.
• Notwithstanding the foregoing provisions of this section, if it is determined that a student's violation of the student market rules and restrictions may also constitute a violation of the UTC Student Code of Conduct, the University Center will refer the matter to the Office of Student Conduct for resolution in accordance with the process and procedures under the UTC Student Code of Conduct. Students who are found responsible for violating the UTC Student Code of Conduct may be subject to disciplinary sanctions, up to and including suspension or dismissal from UTC.
Procedure for Approval of Student Market Events:
This section sets forth the procedure for approval of a student market event. This procedure applies only to student market events subject to the approval of the University Center.
1. Application – Required Information and Documents
• Submit an application to become a student vendor at least 60 days prior to the proposed market date. The application must include the following information: o Student Name
• If a collective student request, submit name of responsible party and list of all students involved.
o Contact Information
o Preliminary Market Catalog of Goods
• The catalog should include the following information:
• Name of Item
• Photo of Item
• Item Description
• A final market catalog must be submitted at least 2 weeks prior to the event. Day of changes are not permitted without approval of the University Center.
o Transaction method(s) o Date(s) of market o Space Requested
o If selling licensed goods, proof of right to sell must be submitted with the application
• IP license must include a direct contact to the IP owner
• Certificate of Insurance submitted at least 2 weeks prior to market date.
o Depending on the nature of market and expected attendance, the market will be subject to one of the below risk levels. Risk level will be communicated to the applicant at least 30 days prior to market date:
• Low Risk
• Medium Risk
• High Risk
2. Approval
• The student's application will be submitted to following departments for approval:
o University Center – University Center Space request approval
• If space is not controlled by the University Center, approval request will be routed to the appropriate department.
o University Center – If applicable, IP/licensing verification
• Verification initiated via email, market will not be approved until verified or item for sell is dropped from submitted catalog
o Enrollment Management and Student Affairs – Student(s) current standing with
University verification o Environmental Health and Safety – COI approval
• If approved, the student will be entered into DASH as a vendor. This process will be completed by the University Center.
3. Inspections
• The University Center will perform random inspections of student markets approved by the University Center to ensure compliance with the student market rules and requirements.
• The University Center is not responsible for inspections of on-campus student markets approved by other University units (e.g., students markets organized and approved by the Gary W. Rollins College of Business).
